The Law on Drug Driving in Scotland

Currently, you can be charged with drug driving if drugs, whether illegal or prescription, cause your driving to be impaired. Impairment is assessed at the roadside using the “field impairment test”. If you fail this test, you will be taken to a police station and required to provide a blood sample.

The law on drug driving is due to change in 2019 and will bring Scotland in line with England and Wales in this area. The updated law will introduce roadside drug testing by police and will also see specific limits introduced for a number of drugs. Roadside drug testing will involve a mouth swab, which will indicate the presence of drugs where there is a colour change after a short time. The test will only detect some drugs; a blood test taken at a police station will be required for certain other drugs.

Under the changes, some drugs will be subject to specified limits, while a zero-tolerance approach will apply to others.

Penalties for Drug Driving in Scotland

The penalties available to courts for those found guilty of drug driving both now and after the change in law are a minimum 12-month driving disqualification, six months’ maximum imprisonment and/or a fine of up to £5,000.
